Terms and conditions

Between NATALIE BODART, on behalf of NATHAN, CP 1805, SAINT ALEXIS DES MONTS - J0K 1V0 - QUEBEC (hereinafter referred to as "Azuline" or as "Us") and every person wanting to purchase (the "Client") through www.azuline.com (hereinafter referred to as the "Website").

1. General Terms

These general terms of business ("Terms and conditions") apply to all orders made through the Website.
Azuline reserves the right to adapt or to modify at any time the general terms and conditions. In case of modification of the present GTCs, every order will be subjected to the GTCs in force at the time of the order.

2.  Products offered

The products offered by Azuline are sold as they are described on the order's summary approved by the client during the confirmation of the transaction. The products' aspects might differ from their photo on the website.

3. Warranty

Azuline's products warranty
a) All our silver jewels are guaranteed silver 925/1000, controlled and hallmarked. They're guaranteed 1 year for any workmanship defect, provided they're subject to normal use.
b) All our gold plated jewels have a brass base. The layer of gold is gold 750/1000 and we warranty a thickness of 3 micrometers minimum. They're also hallmarked and guaranteed 1 year for any workmanship defect, provided they're subject to normal use.
c) Our jewels in steel are made in surgical steel 316L (unless otherwise specified) They are also guaranteed 1 year for any workmanship defect, provided they're subject to normal use.
d) Costume jewels aren't concerned by paragraphs a) to c). They are guaranteed for any workmanship defect only for 3 months (from the reception of the product).
Warranty of products from an other brand than Azuline
a) For all jewels from an other brand than Azuline, the guaranty applied is the one offered by this particular brand. For more details, check the product's description.
Warranty - Rule applicable to every products
a) Products offered by Azuline are only guaranteed by the warranties specified above, or the legal guaranty if applicable.
b) Azuline warranty its products in one of the following ways:
- Repair the product
- Replace the product; or
- A full refund
c) Azuline doesn't warranty any product coming from an other website.
d) The warranty doesn't cover damage caused by accident, misuse and abuse, negligence, use of perfume on the product and attempted repair.
e) Every request related to warranty has to be made by the Client to Azuline and approved by Us before sending the product back. Please contact us at the details mentioned below.
f) All conditions related to a guaranty are the ones mentioned in the After Sale Service section below.
g) The guaranty offered by Azuline cannot be transferred by the Client to anyone.

4. Price

Azuline reserves the right to change all the prices on the Website at any time. Price variation will not be applied after your order submission. The prices indicated at the time of the order are the ones that will be applied.
All our prices are calculated in Canadian Dollars and excluded any charge. The prices indicated doesn't include charge for delivery (if applicable). Any charge omission made by Azuline doesn't free the Client to pay this charge. For details concerning discount for larger quantities, please contact Us.
The payment has to be made in Canadian Dollars or USD and must correspond to the total price indicated on the checkout page.

5. Payment conditions and methods

The only payment methods accepted on the Website are MasterCard, Visa and American Express credit cards and PayPal.

6. Orders

By placing an order through the Website, the Client recognizes having read and accepted the present GTCs, including the Website terms of use and the Privacy policy, which are included here. The products are Azuline's propriety exclusive until the entire payment of the check.
A confirmation of the order's reception is automatically sent by email to the Client to the address he/she gave earlier. The Client must verify that the mailbox is configured to receive emails coming from Us before the checkout.
Azuline is not responsible for non-reception of emails caused by the mailbox of the Client.
Every order can be cancelled by email or phone by the Client before the expedition of the parcel. Azuline is not responsible for any cancellation requested after the expedition of the order.
The order is registered after the payment and confirmed solely after the acceptation of payment by the bank; or cancelled if the bank refuses the payment.
Every order whose payment has been confirmed will lead to a bill on which appear applicable taxes, shipping costs and any other charges (applicable at the time of the order's submission). The bill includes the total price in Canadian Dollars or in USD and the name given by the Client during the order's process.

7. Delivery

The products displayed on the Website are intended to be sold in Canada and USA. Azuline reserves the right to accept or not the delivery in another area.
Shipping and processing costs
The product's delivery can be done by one or the other shipping options offered on the Website, knowing that these services are completely external to Azuline. Azuline is not liable for the shipping services or for Client's negligence regarding the choice made for the delivery.
Shipping costs included transport fees and processing costs (order's preparation, billing).
Shipping costs may vary regarding the price of the order, the parcel's weight or format, the transporter and the destination. The shipping costs applied are the ones displayed during the checkout and accepted by the Client.
Terms of delivery
Every order will be sent only after the reception of the entire payment of this one. The orders are shipped within 10 business days following the payment (usually 2 working days).
The products and the bill will be delivered at the shipping address given by the Client. The address must be the full address. Azuline is not responsible for the non-reception of the parcel in case of a wrong address.
Any change of shipping address for an order already confirmed can only be changed by email or phone, at the contact details mentioned below.
Unless otherwise specified, all shipping are tracked. The tracking is available in the section "My orders" of the Website once the Client is logged in. Other shipping options can be offered but can be subjet to additional charges.

8. Return

All return procedure can be done after request at this address : 387, rue Notre Dame Ouest - MONTREAL H2Y 1V2
and are concerned by the following conditions.
Cancellation and Exchange
Azuline do not cancel or reimburse any order made on the Website except in case of a guaranty.
If the Client is not satisfy with the product ordered, any product bought on the Website can be exchanged. Note that it is not possible to return product damaged, modified or altered in any way. Exchanges are possible within 15 days (after the reception's date)  in their original packaging with a copy of the proof of purchase (receipt).
In case of a positive price variation, you will be credited the difference; in case of negative price variation, the difference will be charged before the shipping of the new product.
After Sale Service
In case of a return in After Sale service of a product after acceptation by Us (any return made without a request to our services will be refused and causes additional fees), the Client must join in the parcel a copy of the proof of purchase in which the product appears.
The After sale service usually takes 1 to 8 weeks, but it may vary depending on the product and the supplier.
After Sale service return fees are charged to the Client, shipping costs (once the product is repaired) are at the expense of Azuline in case of a defect covered by the guaranty. If not, the costs are charged to the client.
If Azuline is in the incapacity to repair a product, the amount will be deducted from the next purchase.
In case of a proved defect or the reception of a broken product and notified to the person in charge of the delivery, shipping costs will be refunded to the client up to 20$ and a new product will be sent or a refund will be credited on the client Website account.

Personal Data
Azuline's privacy policies apply fully to every transaction made through the website and are incorporated into and form part of these GTCs.
Legal
Every transaction made through the Website are governed by Quebec's law and Canadian law applicable in Quebec, excluding any conflict-of-law rule or other applicable laws.
